Any updates will be reflected on our website and we encourage you to view this regularly. You have our full commitment to protecting your personal data that we collect, receive and disclose and that it’s in accordance with the Privacy Act, 1988 Commonwealth (Privacy Act)
3. What does this Privacy statement apply to?
To personal information as defined in the Privacy Act. Generally, personal data is information or an opinion in any form, about an individual (not a company or trust) whose identity is likely or can be ascertained from the information at hand. Our obligation relating to the data we collate as part of a commercial agreement is directed by the confidential information undertaking in the commercial financial services arrangement. By executing the agreement with us, you agree to the collection, use and disclosure of personal data reflected in this Privacy Statement. You are under no obligation to disclose any personal data to us; however, this may result in us not being able to process your application.

We undertake to collect, store and use personal data which is compliant with the Privacy Act. (4) to provide you with marketing material about financial services and products we may provide; (5) to manage and administer the agreement with you; (6) to protect our legal interests; (7) to follow your instructions; and (8) any discussions with a third party regarding am assignment of the loans or partial or full acquisition of the business.

Plexe collects and discloses personal data as it deems necessary to effectively process your application and to fulfil your requests. The data we may collect or disclose includes, when permitted by law: (1) identification data; (2) that you have made an application for credit, the dollar amount and credit type; (3) if repayments are greater than 60 days overdue; (4) that defaults are remedied or overdue payments are no longer overdue; (5) data as to whether you have committed a serious infringement of credit; (6) data about cheques dishonoured; (7) your repayment history; (8) data about court judgments made against you; (9) data which is publicly available in the public domain and relevant to your credit worthiness; (10) insolvency information from the National Personal Insolvency Index. Third Party Service Provider Subject to the Privacy Act, in the process of providing you with the services, we may share personal information with related bodies corporate and with third parties with whom we have dealings in the usual course of carrying on our business. These third-party service providers may include agents, portfolio managers, mail house operators, collection agencies, research providers, dispute resolution schemes, financiers and accounting, legal and other advisers.

For general information regarding our services only, you may speak to us without providing your identity, however for any finance applications we will require your personal information to confirm your identity for Anti-Money Laundering and Counter-Terrorism Financing Rules and to assist in processing your finance application.
10. Accessing and updating your personal data
Subject to a proper identification process, you may access, or update any personal information we have about you in writing from our privacy officer at E-mail: team@plexe.com.au. There is no charge to make a request however we may charge an administration fee for providing access or updating your personal details we have on you if the information is incorrect. If for any reason this is unavailable, we will notify you in writing with reasons. All requests will be handled within a reasonable time period and we will follow due process to correct information we believe is incorrect.

We maintain strict protocols to ensure all reasonable care is taken to protect and avoid any unauthorised access, changes, disclosure, harm or loss of your data and in the unlikely event this happens, we will immediately inform the effected parties with any data they request with reference to the breach of pivacy.

If you believe we haven’t acted in accordance with our obligations under the Privacy Act or the registered Credit Reporting Code or as a credit provider, we encourage you to contact our privacy officer at team@plexe.com.au. We will endeavour to resolve any complaint or request internally and if dissatisfied with our recommended decision you can refer your complaint to either the Australian Financial Complaints Authority (www.afca.org.au or 1800 931 678) or Office of the Australian Information Commissioner (www.oaic.gov.au or 1300 363 992). Your personal information is unlikely to be disclosed to overseas recipients in other countries. In this event we will ensure that they protect the privacy of your data as we are committed under this statement.
